1. Agreement to Terms
Welcome to Pickseat.
These Terms of Service govern your access to and use of the Pickseat mobile application, website, services, content, features, and related technologies (collectively, the "Services").
The Services are provided by Pickseat Transport Services("Pickseat", "we", "our", or "us").
By accessing, downloading, registering for, or using Pickseat, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Services.
2. Description of Services
Pickseat is a transportation technology platform that enables users to:
- Discover vehicles in real time
- View transportation routes
- Locate nearby stations and stops
- Access route-related information
- Connect with participating drivers and transport operators
- View transportation-related content and advertisements
- Access other transportation-related services offered through the platform
Pickseat is a technology platform and does not necessarily own, operate, or control vehicles listed on the platform unless expressly stated.
3. Eligibility
To use Pickseat, you must:
- Be at least 18 years old or the age of legal majority in your jurisdiction
- Have the legal capacity to enter into contracts
- Provide accurate registration information
- Comply with applicable laws
We may refuse service or suspend accounts at our discretion where permitted by law.
4. User Accounts
You may be required to create an account. You agree to:

- Keep information updated
- Maintain account security
- Protect login credentials
- Notify us immediately of unauthorized account access
You are responsible for all activity occurring under your account.
5. Driver Accounts
Drivers and transport operators may be required to provide:

- Insurance information where required
- Additional verification information
Pickseat may verify submitted information but does not guarantee the accuracy of information supplied by drivers.
Drivers remain solely responsible for maintaining valid licenses, permits, registrations, and legal operating authority.
6. Real-Time Location Services
Pickseat uses location services as a core feature.
By using the Services, users acknowledge and consent to location collection and processing as described in our Privacy Policy.
Drivers
Drivers who enable live tracking authorize Pickseat to:
- Display vehicle locations
- Share route information
- Provide visibility to passengers
- Improve transportation discovery
Passengers
Passengers may allow Pickseat to access location information to:
- Identify nearby transportation options
- Improve route recommendations
- Display relevant transport services
Location services may not always be accurate or uninterrupted.
7. Transportation Disclaimer
Pickseat provides transportation information and discovery tools.
We do not guarantee:
- Vehicle availability
- Driver availability
- Route accuracy
- Arrival times
- Service quality
- Transportation safety
- Transportation legality
Transportation services are ultimately provided by independent operators unless otherwise stated. Users assume risks associated with transportation services.
8. No Employment Relationship
Nothing in these Terms creates:
- Employment relationships
- Partnerships
- Joint ventures
- Agency relationships
between Pickseat and independent drivers, operators, passengers, advertisers, or users.
Drivers operate independently unless otherwise stated in a separate written agreement.
9. User Conduct
Users agree not to:
- Violate laws
- Impersonate others
- Submit false information
- Harass other users
- Engage in fraudulent activity
- Disrupt platform operations
- Upload malicious software
- Attempt unauthorized access
- Interfere with security features
- Abuse customer support
Violation may result in suspension or permanent account termination.
10. Prohibited Activities
Users may not use Pickseat for:
- Criminal activities
- Fraudulent transportation activity
- Human trafficking
- Unauthorized solicitation
- Illegal advertising
- Harassment
- Hate speech
- Dangerous conduct
- Distribution of harmful content
We reserve the right to investigate and report violations.
11. Advertisements and Sponsored Content
Pickseat may display:
- Advertisements
- Sponsored content
- Promotional campaigns
- Commercial messages
We do not guarantee the accuracy, quality, legality, or reliability of third-party advertisements.
Users interact with advertisers at their own risk. Any transactions between users and advertisers are solely between those parties.
12. User Content
Users may submit content including:
- Profile information
- Feedback
- Reviews
- Comments
- Support requests
By submitting content, you grant Pickseat a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute such content for operating and improving the Services.
You remain responsible for content you submit.
13. Intellectual Property
The Services and all related content, including:
- Software
- Logos
- Designs
- Graphics
- Text
- Databases
- Trademarks
are owned by Pickseat or its licensors and are protected by applicable intellectual property laws.
No ownership rights are transferred to users.
14. Fees and Payments
Certain services may involve fees. Users agree to pay applicable fees disclosed through the platform.
Pickseat may modify pricing at any time.
Failure to pay may result in service restrictions or account suspension.
Where payment processors are used, transactions may be subject to additional terms imposed by those providers.
15. Refunds
Refund eligibility, where applicable, will be determined according to:

- Platform policies
- Transaction circumstances
Refund requests may be reviewed individually.
16. Account Suspension and Termination
Pickseat may suspend or terminate accounts for reasons including:
- Violations of these Terms
- Fraud
- Abuse

- Legal compliance requirements
We may remove content or restrict access without prior notice where reasonably necessary.
17. Service Availability
We strive to provide reliable services but do not guarantee uninterrupted operation.
Services may experience:
- Downtime
- Delays
- Errors
- Technical issues
- Maintenance interruptions
Pickseat shall not be liable for service interruptions.
18. Third-Party Services
The Services may integrate with third parties, including:
- Mapping providers
- Payment processors
- Analytics providers
- Advertising networks
- Authentication providers
Pickseat is not responsible for third-party services or their practices. Use of third-party services may be subject to separate terms.
19. Disclaimer of Warranties
To the fullest extent permitted by law, Pickseat is provided on an "AS IS" and "AS AVAILABLE" basis.
We make no warranties regarding:
- Accuracy
- Reliability
- Availability
- Fitness for a particular purpose
- Non-infringement
Use of the Services is at your own risk.
20. Limitation of Liability
To the maximum extent permitted by law, Pickseat, its affiliates, officers, directors, employees, and partners shall not be liable for:
- Indirect damages
- Incidental damages
- Consequential damages
- Lost profits
- Lost revenue
- Personal injury
- Property damage
- Transportation-related incidents
- Data loss
arising from use of the Services.
Where liability cannot legally be excluded, liability shall be limited to the maximum extent permitted by applicable law.
21. Indemnification
You agree to defend, indemnify, and hold harmless Pickseat and its affiliates from claims, damages, liabilities, losses, costs, and expenses arising from:
- Your use of the Services
- Your violations of these Terms
- Your conduct toward other users
- Your violation of applicable laws
22. Privacy
Use of the Services is also governed by the Pickseat Privacy Policy.
By using Pickseat, you acknowledge the privacy practices described therein.
23. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Ghana without regard to conflict-of-law principles.
24. Compliance with Ghana Transport Laws
Pickseat operates as a technology platform supporting lawful transportation services within the Republic of Ghana. All users, drivers, transport operators, and vehicle owners using the Services agree to comply with all applicable laws and regulations, including:
- Road Traffic Act, 2004 (Act 683), as amended
- National Road Safety Authority Act, 2019 (Act 993)
- Any applicable regulations, directives, licensing requirements, or standards issued by competent governmental authorities
Failure to comply with applicable laws may result in suspension or permanent termination of access to the Services.
25. Dispute Resolution
Before initiating legal proceedings, users agree to first contact Pickseat to attempt informal resolution.

26. Changes to These Terms
We may modify these Terms from time to time.

27. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
28. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between users and Pickseat regarding the Services.
