Driver Terms & Conditions
1. Introduction
These Driver Terms & Conditions ("Driver Terms") govern the relationship between Pickseat Transport Services ("Pickseat", "we", "our", or "us") and individuals or entities who register as drivers or transport operators on the Pickseat platform.
By registering as a driver on Pickseat, you agree to be legally bound by these Driver Terms, in addition to our general Terms of Service and Privacy Policy.
These Driver Terms are a legally binding agreement between you and Pickseat. If you do not agree to these terms, you must not register as a driver on the Pickseat platform.
2. Definitions
In these Driver Terms, the following definitions apply:
- "Driver" means any individual or entity registered on the Pickseat platform to provide transportation services.
- "Driver Account" means the account created by a Driver on the Pickseat platform.
- "Passenger" means any user of the Pickseat platform seeking transportation services.
- "Transportation Services" means the services provided by Drivers to Passengers through the Pickseat platform.
- "Vehicle" means any motor vehicle registered and used by a Driver to provide Transportation Services.
- "Platform" means the Pickseat mobile application, website, and related services.
- "Fare" means the fee payable by a Passenger for Transportation Services.
- "Service Fee" means the fee charged by Pickseat to Drivers for using the Platform.
- "Driver Information" means all information provided by a Driver to Pickseat, including personal information, vehicle information, and documentation.
3. Eligibility
To register as a Driver on Pickseat, you must meet the following requirements:
3.1 General Requirements
- Be at least 21 years of age or the minimum age required by law
- Have a valid driver's license issued by the Republic of Ghana
- Have a valid vehicle registration and insurance
- Have a clean driving record (no major violations in the past 5 years)
- Pass a background check conducted by Pickseat or an authorized third party
- Have a vehicle that meets our safety and quality standards
- Provide all required documentation and information
3.2 Vehicle Requirements
- Vehicle must be in good working condition
- Vehicle must pass safety inspection
- Vehicle must be properly registered and insured
- Vehicle must meet age and model requirements (as specified)
- Vehicle must have valid roadworthiness certificate
3.3 Documentation
Drivers must provide and maintain current:
- Valid driver's license
- Vehicle registration documents
- Valid insurance certificate
- Roadworthiness certificate
- Government-issued identification
- Any other documentation required by law or Pickseat
Failure to maintain eligibility requirements may result in immediate suspension or termination of your Driver Account.
4. Registration Process
4.1 Application
- Complete the driver registration form on the Platform
- Submit all required documentation
- Consent to background and driving record checks
- Agree to these Driver Terms
- Complete any required training or onboarding
4.2 Verification
- Pickseat will verify all submitted information and documentation
- We may use third-party services for verification
- Verification typically takes 3-7 business days
- We may request additional information during verification
4.3 Approval
- Pickseat reserves the right to approve or reject any driver application at our sole discretion
- Approval is contingent on meeting all eligibility requirements
- We may revoke approval at any time for any reason permitted by law
5. Driver Obligations
5.1 Service Standards
Drivers agree to:
- Provide safe, reliable, and professional transportation services
- Maintain a clean and well-maintained Vehicle
- Follow all traffic laws and regulations
- Use the Platform responsibly and ethically
- Treat Passengers with respect and courtesy
- Provide accurate and truthful information
- Maintain required insurance and licenses
5.2 Conduct
Drivers must not:
- Discriminate against any Passenger
- Harass or abuse Passengers
- Engage in any illegal activity
- Operate under the influence of alcohol or drugs
- Share Passenger information without consent
- Accept cash payments without authorization
- Solicit Passengers for private arrangements
- Provide false or misleading information
5.3 Communication
- Respond promptly to Passenger requests
- Communicate professionally and clearly
- Report any issues or incidents immediately
- Keep contact information updated
- Check Platform notifications regularly
Violation of these obligations may result in suspension or permanent termination of your Driver Account.
6. Independent Contractor Status
Drivers are independent contractors and not employees, agents, or partners of Pickseat. This means:
- Drivers are free to choose when and how often to provide services
- Drivers are responsible for their own taxes and benefits
- Drivers are responsible for their own operating costs
- Drivers are not entitled to employee benefits from Pickseat
- Drivers may work for competing platforms
- Drivers are responsible for their own insurance
Nothing in these Driver Terms creates an employment relationship, partnership, joint venture, or agency relationship between Pickseat and Drivers.
7. Vehicle and Safety Standards
7.1 Vehicle Maintenance
- Drivers must maintain their vehicles in safe operating condition
- Regular maintenance and inspections are required
- Any safety issues must be reported immediately
- Vehicles must be clean and presentable
- Vehicles must have functional safety features (seatbelts, brakes, etc.)
7.2 Safety Requirements
- Drivers must follow all safety regulations and best practices
- Passengers must be transported safely and legally
- Children must be transported according to applicable child safety laws
- Drivers must not exceed passenger capacity
- Drivers must not transport hazardous materials
7.3 Vehicle Inspections
- Pickseat may conduct vehicle inspections at any time
- Drivers must cooperate with inspections
- Failed inspections may result in service suspension
- Drivers are responsible for ensuring vehicles pass inspections
8. Insurance and Liability
8.1 Driver Insurance
- Drivers must maintain valid and adequate insurance for their Vehicles
- Insurance must cover third-party liability, personal injury, and vehicle damage
- Drivers must provide proof of insurance and keep it current
- Drivers are responsible for all insurance costs and claims
8.2 Liability
- Drivers are solely responsible for their actions and any incidents
- Pickseat is not liable for any accidents, injuries, or damages
- Drivers must report any accidents or incidents immediately
- Drivers must cooperate with any investigations
8.3 Passenger Safety
- Drivers are responsible for the safety of Passengers during rides
- Drivers must not drive while impaired or distracted
- Drivers must ensure Passengers follow safety requirements
- Drivers must have emergency procedures in place
Drivers are fully liable for any incidents that occur during the provision of Transportation Services. Pickseat strongly recommends that Drivers carry comprehensive commercial insurance.
9. Fares and Payments
9.1 Fare Structure
- Fares are determined by Pickseat based on distance, time, and other factors
- Pickseat may adjust fares at any time with notice to Drivers
- Drivers agree to the fare structure set by Pickseat
- Fare estimates are provided before Passenger confirmation
9.2 Service Fees
- Pickseat charges a Service Fee for each transaction (typically 10-20% of the Fare)
- Service Fees are deducted from Driver earnings
- Pickseat may modify Service Fees with notice
- Service Fees are disclosed before Driver acceptance
9.3 Driver Earnings
- Driver earnings are calculated as Fare minus Service Fee
- Payments are made through the Platform
- Drivers must have valid payment information on file
- Earnings are paid according to the payment schedule
9.4 Payment Processing
- All payments are processed through the Platform
- Cash payments are not permitted unless expressly authorized
- Payments are processed by third-party payment providers
- Any payment issues should be reported immediately
Payments are made weekly or according to the schedule specified on the Platform. Drivers must have a valid bank account or mobile money account registered for payments.
10. Driver Account Management
10.1 Account Information
- Drivers must keep their account information accurate and up to date
- Changes to information must be updated promptly
- Drivers are responsible for account security
- Drivers must report any unauthorized access immediately
10.2 Account Suspension
Pickseat may suspend driver accounts for:
- Violation of these Driver Terms
- Fraud or misconduct
- Safety concerns
- Legal requirements
- Low performance metrics
- Failure to maintain required documentation
10.3 Account Termination
Pickseat may permanently terminate driver accounts for:
- Serious violations of these Driver Terms
- Illegal activity
- Gross misconduct
- Fraud or dishonesty
- Safety violations
- Abuse of the Platform
11. Performance Standards
Drivers are expected to maintain the following performance standards:
11.1 Reliability
- High acceptance rate for ride requests
- Low cancellation rate
- Punctuality and reliability
- Consistent availability during active hours
11.2 Quality
- High passenger ratings (typically 4.5 stars or above)
- Positive passenger feedback
- Professional behavior and presentation
- Clean and comfortable vehicles
11.3 Efficiency
- Efficient route navigation
- Minimal idle time
- Quick response to requests
- Effective use of the Platform
Failure to maintain performance standards may result in reduced ride allocation, account suspension, or termination.
12. Passenger Safety and Experience
12.1 Passenger Safety
- Drivers must ensure passenger safety at all times
- Drivers must follow all safety protocols
- Emergency procedures must be in place
- Drivers must report any safety incidents immediately
12.2 Passenger Experience
- Drivers must provide a positive passenger experience
- Drivers must be courteous and professional
- Drivers must maintain a clean and comfortable vehicle
- Drivers must assist passengers as needed
12.3 Complaints and Issues
- Drivers must handle passenger complaints professionally and promptly
- Serious complaints must be reported to Pickseat
- Repeated complaints may result in action against the driver account
- Drivers must cooperate with complaint investigations
13. Use of Platform
13.1 Proper Use
- Drivers must use the Platform in accordance with these Terms
- Drivers must not manipulate the Platform or its features
- Drivers must not create multiple accounts
- Drivers must not share accounts with others
13.2 Prohibited Activities
Drivers must not use the Platform for:
- Illegal or fraudulent activities
- Harassment or discrimination
- Soliciting for private arrangements
- Competitive activities
- Any activity prohibited by law
13.3 Platform Updates
- Drivers must keep the Platform updated to the latest version
- Updates may include changes to features and functionality
- Continued use after updates constitutes acceptance of changes
14. Confidentiality
- Drivers must maintain confidentiality of all Platform information
- Driver Information must not be shared with unauthorized parties
- Passenger information must remain confidential
- Platform trade secrets must be protected
- Confidentiality obligations survive account termination
15. Data Protection
- Drivers must comply with all applicable data protection laws
- Driver Information is processed in accordance with our Privacy Policy
- Drivers must protect Passenger data as required by law
- Any data breaches must be reported immediately
16. Termination
16.1 Termination by Driver
- Drivers may terminate their account at any time
- Termination must be requested through the Platform
- Earnings due will be paid after termination
- Certain obligations survive termination
16.2 Termination by Pickseat
Pickseat may terminate driver accounts for:
- Violation of these Driver Terms
- Illegal or fraudulent activity
- Safety concerns
- Business reasons (with notice)
- Any reason permitted by law
16.3 Effect of Termination
- Access to the Platform will be revoked
- Earnings will be paid (less any amounts owed)
- Obligations under these Terms survive
- Driver Information may be retained as required by law
17. Dispute Resolution
- Drivers should first attempt to resolve disputes with Pickseat informally
- Disputes may be escalated to mediation or arbitration
- Courts in Ghana have jurisdiction over disputes
- These Driver Terms are governed by Ghana law
18. General Provisions
18.1 Amendments
Pickseat may amend these Driver Terms at any time. Continued use of the Platform constitutes acceptance of amended terms.
18.2 Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
18.3 Severability
If any provision is found invalid, the remaining provisions remain in effect.
18.4 Assignment
Drivers may not assign these Driver Terms without Pickseat's consent. Pickseat may assign these terms at any time.
